Right to Request Restrictions

The patient has the right to request an organization to restrict the use and disclosure (release) of their confidential information
- Can request restriction in use of information for treatment, payment, or health care operation purposes.
- Organization is not required to agree with restriction(s).
- Patient can request to receive communication by alternative means or locations.
Another new right of the patient under HIPAA, is the right to request a restriction on how confidential information is used or disclosed. Every patient has the right to request a restriction, including restricting how it is used for treatment, for payment, or for health care operation. However, a health care organization can choose if they will honor the request.
Patients also have the right to request that they receive communication from a health care provider or payer by an alternative means or at an alternative location. For example, a patient can request that information about an upcoming appointment be left on their work voicemail rather than at a home phone number. An organization must honor the request for communication at a location of the patient's choice.
